In consideration of being allowed to participate in any way in the program, related events and activities, I the undersigned, acknowledge, appreciate, and agree that:

     1. The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death.
     2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation.
     3. I willingly agree to comply with terms and conditions for participation. If I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately.
     4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS OR-CAL Adventures, LLC d/b/a Rogue Klamath River Adventures, d/b/a The Tahiti Hut, d/b/a Ten Thousand Trails, its officers, officials, agents and/or employees, other participants, sponsors, advertisers, and, if applicable, owners and lessors of premises used to conduct the event (RELEASEES), from any and all claims, demands, losses, and liability arising out of or related to any INJURY, DISABILITY OR DEATH I may suffer, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE; to the fullest extent permitted by law. This does not apply to claims, demands, losses or liability determined to be the result of the Gross Negligence or the Wanton and Willful Misconduct of the Releasees.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree to his/her release as provided above of all the Releasees, and, for myself, my heirs, assigns, and next of kin, I release and agree to indemnify and hold harmless the Releasees from any and all liability incidents to my minor child's involvement or participation in these programs as provided above, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES, to the fullest extent permitted by law. This does not apply to liability incidents determined to be the result of the Gross Negligence or the Wanton and Willful Misconduct of the Releasees.

Written cancellations must be received 30 days prior to your trip. YOUR DEPOSIT IS NON-REFUNDABLE but will be applied to another trip in our current season. If paid, the balance of fare will be refunded. If a trip is canceled in less then 30 days, your deposit and balance of fare will be applied to a comparable trip during the season. If a cancellation occurs within 10 days or you're a no show, all funds will be forfeited.

We seldom cancel or postpone a trip, but we reserve the right to do so if necessary due to weather, water conditions, insufficient reservations, or other factors beyond our control. In such case, all fees will be refunded or applied to another trip, but not expenses incurred in travel.

I HAVE READ AND UNDERSTOOD THE REFUND POLICY set out by ROGUE KLAMATH RIVER ADVENTURES, and agreed to accept whatever refund is due me in the event of cancellations by ROGUE KLAMATH RIVER ADVENTURES, or by me, as a full settlement of all agreements.

Please Note: All Rogue Klamath River Adventures trips are conducted with the permission, approvals, required permits and licenses, and within the established guidelines of: the Oregon Marine Board; The United States Department of Interior; The Bureau of Land Management - Medford and Vale District Offices, and the Klamath Falls Resource Area; the U.S. Forest Service - Rogue and Klamath National Forests.
